Terms of Service

1. Acceptance of Terms

By accessing or using the CallScaler platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all users, including visitors, registered users, and paying customers.

2. Description of Service

CallScaler provides call tracking, call management, AI transcription, analytics, and pay-per-call management tools via a web-based platform and API. The Service includes phone number provisioning, call routing, recording, transcription, and integration with third-party advertising platforms.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old to use the Service.

4. Billing and Payment

CallScaler uses a prepaid balance model. You add funds to your account, and usage charges (phone numbers, minutes, SMS, transcription) are deducted automatically. Monthly plan fees are charged to your balance every 30 days. Auto top-up can be enabled to prevent service interruption. All payments are non-refundable unless required by law.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Send unsolicited commercial communications (spam)
  • Transmit malicious software or interfere with the Service
  • Impersonate any person or entity
  • Use the Service for illegal telemarketing or robocalling
  • Attempt to gain unauthorized access to other accounts

6. Call Recording Compliance

You are solely responsible for complying with all applicable call recording laws, including federal and state wiretapping statutes. Many jurisdictions require all-party consent for call recording. CallScaler provides tools (call greetings) to help with compliance, but you are responsible for proper disclosure.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your data. CallScaler processes call data to provide the Service, including AI transcription and analysis. We do not sell your data to third parties.

8. Service Availability

We target 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable advance notice. We are not liable for downtime caused by factors outside our control, including internet infrastructure, third-party services, or force majeure events.

9. Intellectual Property

The Service, including its design, code, and documentation, is owned by CallScaler. You may not copy, modify, distribute, or reverse-engineer any part of the Service. You grant CallScaler a limited license to use your brand assets for the purpose of providing the Service (e.g., white-label features).

10. Termination

Either party may terminate this agreement at any time. You may cancel your account through the platform. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be retained for 30 days before deletion.

11. Limitation of Liability

To the maximum extent permitted by law, CallScaler shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use after changes constitutes acceptance.
